These terms govern your use of the Property Databank website, client portal, and any professional services (each an "Instruction") delivered by Property Databank Ltd. ("PDB").
1. Acceptance
By accessing this website or issuing an Instruction to PDB you accept these terms together with any Engagement Letter, Scope of Services, or Fee Schedule signed for your Instruction. In case of conflict, the signed Engagement Letter prevails.
2. Services
PDB provides valuation, agency, property management, facilities management, land administration, research, and advisory services. Deliverables are prepared for the addressee named in the Engagement Letter and may not be relied upon by third parties without our prior written consent.
3. Fees & payment
Fees are agreed in writing before work starts. Invoices are payable within fourteen (14) days unless otherwise agreed. Overdue amounts attract interest at 2% per month or the statutory rate, whichever is higher.
4. Client responsibilities
- Provide accurate title, tenancy, financial and identification information.
- Grant timely site access and provide safe conditions for our inspectors.
- Comply with anti-money-laundering and know-your-customer requests.
5. Intellectual property
Reports, models, drawings, and platform content are the intellectual property of PDB. Clients receive a non-exclusive licence to use deliverables for the purpose stated in the Engagement Letter.
6. Confidentiality
Each party keeps the other's confidential information secure, uses it only for the Instruction, and returns or destroys it on request, subject to legal retention duties.
7. Liability
PDB's total aggregate liability under any Instruction is capped at the greater of (a) the fees paid for that Instruction in the twelve months preceding the claim, or (b) the amount recoverable under our professional indemnity insurance. We are not liable for indirect, consequential, or loss-of-profit damages.
8. Complaints
Complaints follow the procedure at /complaints. Unresolved professional-conduct matters may be referred to the Ghana Institution of Surveyors (GhIS) or, where applicable, RICS Regulation.
9. Governing law
These terms are governed by the laws of the Republic of Ghana. The courts of Accra have exclusive jurisdiction, subject to any arbitration clause in the Engagement Letter.
